Chargeback Provisions *

Client understands that by signing this Agreement and paying on later invoices, Client agrees to all terms and authorizes all charges. In no way will the client file a “fraudulent charge”, “chargeback”, or anything similar with their financial institution or the payment processing system used to process these payments. If a Chargeback should be filed by the Client, the Company retains the right to pursue all possible legal actions to settle the debts, including attorney's and court fees plus a 100.00 chargeback fee. If the Client initiates a Chargeback, the Company may immediately terminate this Contract. Please agree to the terms.

Travel Policy *

We are based in the 38125 area. Any city located 30 miles or more from Memphis, TN, 38125, will incur mileage charges. Please Note: Mileage rates are $1.50 per mile each way. Keep in mind, all rentals require a two hour minimum. By entering the address of the event below, you (the customer), understand and acknowledge that you will receive an additional invoice for travel fees if our rentals will be delivered 30 miles or more from our facility. What is the address in which the rental will be delivered?

Waiver & Release of Liability *

I agree to the Waiver & Release of Liability terms which states: To: [NAME OF PARTY HOST/Organization] (Party Host) Assumption of Risk: 1) I, the undersigned, will be using a motorized, electric or battery operated entertainment vehicle (“Rolling Car”). I recognize and understand that the use of this equipment involves certain risks. Those risks include, but are not limited to, the risk injury resulting from possible malfunction of the equipment. I recognize that the exertion of using this equipment could result in injury or death. 2) Despite these and other risk, and fully understanding such risk, I wish to use the Rolling Car and hereby assume the risks of using the equipment. I also hereby hold harmless the “sponsors” and indemnify them against any or all claims, actions, suits, procedures, cost expenses (including attorney’s fees and expenses), damages liabilities arising out of, connected with, or resulting from using the equipment (Rolling Car), including without limitation, those resulting from the manufacture, selection delivery, possession, use or operation of such equipment. I hereby certify to the Sponsors that those participating will be of good health and do not suffer from a heart condition or other ailment which could be exacerbated by the exertion involved in using the Rolling Car, I further certify that we have and will use their own insurance in any event of injury or mishap. Release of Liability, Waiver of Claims and Indemnity Agreement In consideration of the use of the Rolling Car, I hereby agree as follows: 1. To waive any and all claims that I have or may in the future have against [NAME OF PARTY HOST/Renter], LeeAndrew Fun Adventures LLC, their directors, officers, employees, agents, and representatives (all of whom are hereinafter referred to as “the Releasees”); 2. To Release the Releasees from any and all liability for any loss, damage, injury, expense that anyone may suffer or that next of kin may suffer as a result of any participation with said equipment due to any cause whatsoever. Including negligence on the part of the releasees; 3. To hold harmless and indemnify the releases from any and all liability from any damage to property of, or personal injury to, any third party, resulting from any participation with said equipment. 4. That this Agreement shall be effective and binding upon any heirs, next of kin, executors, administrators and assigns, in the event of any death. I have read and understood this agreement, and I am aware that by signing this agreement I am waiving certain legal rights which I or any other Participant, may have against the Releasees.
